PLEASE READ
All Tri Spirit Events Limited (“Tri Spirit Mallorca”, or “we”, “us”) trips are governed by the terms set out below. Please read them carefully.
When you book a guided cycle trip or any other type of training or guiding with us, you are asked to confirm your understanding and agreement to these terms and conditions in full.
Booking
If a group (more than one person) booking is made by a ‘lead’ individual then this person must be authorised to make the booking on behalf of the group and be over 18 years old. All information about each of the people in the group must be correct and any necessary changes be advised to Tri Spirit Events in advance. They will also be responsible for passing information about the booking back to their party.
Anyone in your party who is under 18 is the sole responsibility of you/your party.
Deposit
If you book a guided week or longer, there is a non-refundable deposit applied to all trips of £100 and the balance for the booking must be paid at least 30 days prior to arrival. If the booking is made within 30 days we require payment in full at the time of booking along with the completed booking form. Failure to meet this requirement will result in your booking being cancelled and your deposit being forfeited.
Once we receive your booking form and your deposit, we will send you confirmation and this will create a binding contract between Tri Spirit Events and you and your entire party, even where you book on their behalf.
Fees
Prices are correct on the date they are published but Tri Spirit Events reserves the right to change prices without notice. These will usually be related to additional costs associated with changes imposed by others on the trip, such as any increase in taxes or additional costs for services Tri Spirit Events uses in offering these training and coaching services.
If these increases boost the price above 10% of your original booking price, we will offer you the chance to withdraw from your trip within seven days of us notifying you of the change, and will refund all monies already paid.
Included in your trip
Tri Spirit Events gives a general outline of the kind of rides, swims and runs or hikes you may do on our website and in any social media posts or advertising. These may be changed to accommodate variables outside of our control, such as the weather, road conditions, injuries to you or your party or variations in the ability of the group.
We will at all times put the safety of our clients first and ensure that we take all measures necessary to provide the best possible experience for all. You will get an itinerary of the training we will provide and you are able to choose if you do not wish to participate in any specific session. But in choosing this, you understand that this will not qualify you for a reduction in fees paid to Tri Spirit Events associated with your trip.
Cancellations
If you choose to cancel your guided trip of one week or longer, you must let us know in writing as soon as possible. For groups, any details of cancellations made should be sent to us by the lead person in your group to keep communications more streamlined.
The best way to tell us is by email or in writing on another trackable form of communication, such as WhatsApp or Facebook Messenger.
We will only accept notification via an electronic form of communication as the post cannot be relied upon to reach us in good time.
If you choose to cancel within 45 days of attending, we will require:
45-30 days – 25% of your booking cost
30-20 days – 50% of your booking cost
20-10 days – 75% of your booking cost
Less than 10 days before arrival – 100% of your booking cost.
Transferring your place
If you are no longer able to come to Mallorca to train with Tri Spirit Events, then if you let us know more than 45 days prior to your arrival date, we will accept a transfer of your booking to a new person, providing you give us all of their details and that they pay their £100 booking fee for our training, and then complete the full payment no less than 30 days prior to arrival.
Transfers may not be made within 30 days of arrival.
Ending your trip early
Tri Spirit Events will not be held responsible for any additional costs you incur because you choose to end your training early or decide to return home early. In this event, any money paid for our services will not be refunded for days when you will not be riding or otherwise training with us.
Changes and cancellations by Tri Spirit Events
There may be times when Tri Spirit Events is required to make changes to planned training or accommodation arrangements and we will let you know of these as soon as possible. We will work to the best of our ability to ensure that a replacement will be provided that is of equal value to what was originally planned.
If we have to cancel any day, week or part of a week of training, we will let you know as soon as possible and we will refund payments already made to us in full. For any other claims, such as flights etc, you should contact your travel insurer. We will not accept further claims for compensation.
Cancellations by clients
Clients who choose to cancel days they have booked with Tri Spirit Events will be expected to pay for the booking they have made in full unless we have more than 30 days notice. This is especially the case if you choose not to take part in a planned cycle ride or other event because of inclement weather. There may however be days where we advise that, for safety reasons, inclement weather means it is not possible to undertake a planned ride. In this case, we will rearrange the day with you at a convenient time during the remainder of your holiday, or make a refund of the payment made if you don’t have sufficient time left to rearrange the day.
Covid-19 Travel Changes
If you are unable to travel to a training week with us because of changes in the travel restrictions due to Covid-19, or because you contract Covid-19, we will refund any money paid in full or transfer your trip to another date, whichever you prefer. We will ask for proof of this status to prevent any abuse of this clause.
Training with Tri Spirit Events
You understand and accept that:
You engage in sport and training at your own risk – Tri Spirit Events accepts no liability for accidents or injuries that result from riding in a group or on the road. Group leaders will take every care to ensure your safety but due to the nature of road riding, sea swimming and running, all individuals taking part do so at their own risk.
Groups may vary in ability – While we will do our best to ensure groups are of a similar ability, we are reliant on people being honest with us and themselves about where their ability sits. The terrain in Mallorca is very varied, with mountain climbs and descents included in the week and all will be done on open roads. The traffic where we hold our training camps is less busy than in the north of the island, but it is important to understand that because of the nature of the riding particularly, we are not able to guarantee the safety of riders or their equipment.
Tri Spirit Events group leaders have the authority to prevent you from undertaking a ride if they feel your ability is below that necessary to complete a specific ride within a reasonable time. This is to maximise the safety of all in the group.
We expect people to behave respectfully and with care towards all others in their group at all times – Group leaders also work to maintain the enjoyment of their group. So our group leaders also have the ability to prevent anyone they feel will limit the enjoyment or safety of the group from riding. Tri Spirit Events and our group leaders accept no liability for this.
You must comply with Spanish traffic and road use regulations at all times – this includes, for example, wearing a cycle helmet and riding on the right-hand side of the road.
You confirm you are fit and healthy enough to participate in the group rides/swims/runs – a certain level of physical fitness is required to complete a training week with Tri Spirit Events and while we cater for novices, it is important that you confirm you are capable of participating safely in activities outlined for your trip.
Recommendations by Tri Spirit Events group leaders on kit are merely recommendations and you should check you have what you personally need for each session. This includes sufficient water/fluids/electrolytes, food and money should you want to buy something at a cafe stop during a ride.
Accessibility
We are happy to accept bookings from people who may have a restricted mobility or a disability, but please call to discuss anything you may need prior to completing the booking with us. We want to do everything we can to ensure we can make any adjustments to planned activities where possible to accommodate your individual condition. We may also need to undertake a risk assessment in relation to any of the activities we offer, so please do be candid about your needs so we can help you as much as possible. If anything changes in advance of your arrival, please let us know.
Our group leaders are advanced level first-aid trained, but if you need additional specialist care then you may need to have a friend or relative accompany you to take responsibility for your care. If this is the case, please let us know in advance and we will work with you to accommodate this.
Contagious diseases/pandemics
As the Covid-19 pandemic brought home to us all, there is particular need to be aware of any possible contagious diseases when dealing with group activities. So, if anyone in your party has developed a contagious or infectious medical condition within four weeks of arriving, you MUST let us know in advance.
We reserve the right to refuse or cancel the booking, or to ask anyone in the group who may be at risk of affecting the health of others to leave if we feel it is necessary.
Insurance
Tri Spirit Events, its agents, employees or other clients are not responsible for your safety and any guidance on any part of your trip – transfers, accommodation and the guided and coached rides – are all undertaken at your own risk.
You need to be fit enough to take part in all activities and confirm you have no pre-existing condition or illness that could be made worse by taking part in the swim, bike and run activities that are undertaken during your stay. If you are unsure, get medical advice before you book.
You also need to ensure you have travel insurance to cover any medical bills, repatriation to your home country, earnings loss, damage or theft of your baggage or other equipment, and to cover any cancellation or curtailment of your trip. Even if the UK Government has replaced the EHIC card with another Europe or worldwide scheme for emergency medical care during your stay after Brexit, you cannot rely on this to cover all costs. So we strongly advise you get proper travel insurance that will cover all activities you are likely to take part in during your trip.
If you choose not to arrange this insurance, then this is at your own risk and Tri Spirit Events takes no responsibility for the consequences of your decision.
Tri Spirit Events accepts no liability for loss, damage, injury or death in connection with your stay or the activities undertaken with us, except where any of the above are caused as a result of the proven negligence of Tri Spirit Events.
Bike Rental
It is possible to hire a bicycle through Tri Spirit Events and we will ensure the cycle is in good working order and fit for road cycling. You agree to maintain the bike in the same state during your hire. If for any reason the bike is not in a working condition, you need to inform a member of the Tri Spirit Events team as soon as possible.
Any changes to the set-up of the bike should only be undertaken by a qualified person. In the case of damage to the bike, you will be charged for the repair of said damage.
When the bike is in your possession but not in use by you, it is your responsibility to ensure it is properly secured at all times. There is an insurance charge that will be confirmed once you hire from us to cover theft and accidental damage.
You must not cycle if you are under the influence of either alcohol or drugs.
Behaviour
The accommodation is in an rural hotel, which is a quiet, group setting and you must ensure your behaviour is appropriate at all times and is not likely to upset, annoy, intimidate or otherwise disturb another guest. We ask that you are not excessively noisy, especially at night.
Mallorca has a different culture to the UK and we would expect you to respect the way life is lived on the island. You must at all times respect local traffic laws, and other laws of the island as relevant.
You will not be offensive or aggressive towards any Tri Spirit Events staff, hotel staff or other clients, and where necessary we would not hesitate to call the police if it became necessary. If we consider your conduct, or the conduct of those in your party, to be inappropriate, likely to harm others, or impair the enjoyment and comfort of those around you either in the hotel or in public, we will ask you or your party to leave immediately.
No refunds or compensation will be given in this event. We will also reserve the right to refuse future bookings from you or other members of the party in question.
Photos
We will occasionally take photos and video footage during your stay which we may use for marketing purposes, and by agreeing to these Ts&Cs by making your booking, you agree to these images being used in this way.
If you are unhappy with your image being used in advertising, marketing or social media or any other forum that we use to promote our business, please tell us in advance. You give us worldwide rights to use your image and no payment will be made for the use of any images, video or other likeness.
Data privacy
Tri Spirit Events complies with GDPR legislation and the Information Commissioner’s Office guidelines and you can find full details in our privacy policy.
Complaints
If you are unhappy with any aspect of your stay with us, then please let one of the Tri Spirit Events staff know in the first instance and we will endeavour to resolve any issues informally and as quickly as possible during your stay.
If you are not happy that your complaint has been dealt with, then please send us a complaint in writing within two weeks of the end of your stay and we will endeavour to resolve this to mutual satisfaction as soon as we can after that.
Security
Any personal belongings you bring with you are your sole responsibility during your stay. You should bring a bicycle lock with you that is light enough to fit into a back pocket or can be carried easily on the bike itself.
Accommodation
We work closely with the Hotel Sa Franquesa Nova as it is perfectly set up for all athletes taking part in training weeks with us. But if there is not enough room for your party at the hotel on the requested dates, then we will look for alternative accommodation for you and will advise you of this in advance of your stay.
If you would prefer to stay at a coastal hotel, then please inform us in advance and we will do our best to find you a suitable alternative, but this may result in increased costs to you depending on the price of the alternative accommodation.
Please note, in most cases we will not book the accommodation for you – it is usually easier for you to deal directly with the hotel yourself as there is then no delay in communication. But if you specifically want us to arrange your accommodation for you, then please let us know. There may be an administration cost for this.
Compensation for excess costs
Tri Spirit Events reserves the right to charge you for any extra amounts we have to pay to others as compensation due to your acts or omissions, property damage, breaches of our terms and conditions or any other outstanding amounts. You agree that these can be charged to your credit or debit card that has been used to pay for your trip with us.
General terms
The terms and conditions as outlined form a contract between you/your party and Tri Spirit Events, and if any part of these terms becomes unenforceable it will not affect any of the remaining terms.
If either party waives a breach of these terms, it does not translate to a waive of any other breach of these terms.
These terms are governed by the law of England and Wales and any disputes arising must be resolved, if not possible through conversation, or professional mediation, under the jurisdiction of an English court.
